General information
The company Skischule Damüls OG
(hereinafter: ‘Skischule Damüls’) provides its services exclusively on
the basis of the following General Terms and Conditions (GTC). These
apply to all legal relationships between the Damüls Ski School and those
persons who utilise the services of the Damüls Ski School (hereinafter:
‘Customer’), even if no express reference is made to them. The business
purpose of the Damüls Ski School is the operation of a snow sports
school (ski school). This includes, in particular, services such as the
provision of instruction in the skills and knowledge of skiing (without
guaranteeing a specific training success) as well as guiding and
accompanying skiing.
The version valid at the time of the
conclusion of the contract is decisive. Deviations from these and other
supplementary agreements with the customer are only effective if they
have been confirmed in writing by Damüls Ski School. Any terms and
conditions of the customer, even if known, are not accepted, unless
otherwise expressly agreed in writing in individual cases. Damüls Ski
School expressly objects to the customer's GTC. No further objection to
the customer's GTC by Damüls Ski School is required.
Insofar as this contract refers to natural persons only in the masculine form, they refer to women and men in the same way.
The
services advertised by Damüls Ski School do not constitute binding
offers, but merely an invitation to the viewer to submit an offer to
Damüls Ski School.

Order and conclusion of contract
Damüls
Ski School advertises its services both on its website,
www.skischule-damuels.at , and on its business premises. The conclusion
of a contract between Damüls Ski School and the customer is possible
both electronically (booking via online shop and acceptance of contract
by confirmation e-mail) and in the business premises of Damüls Ski
School (conclusion of contract by handing over a ticket).
All
offers are subject to change and non-binding. The author expressly
reserves the right to change, supplement or delete parts of the pages or
the entire offer without prior notice or to discontinue publication
temporarily or permanently.
Method of payment
The customer is offered the following payment options to pay for the services ordered via the online shop:
- Payment by credit card
The
customer is offered the following payment options to pay for the
requested services at the Lech Ski School business premises:
- Payment by credit card
- Payment by debit card
- Cash payment
Cancellation policy
- In case of injuries, the days not skied will be refunded on presentation of a medical report. Any parts of days will still be charged as a full day.
- Private course: Cancellation the day before until 16.00 hrs free of charge, after that € 120,00 cancellation fee will be charged.
- If you are unable to start the ski course booked with us in the online shop, we will charge you a deposit/processing fee of € 40,00 up to € 500,00 booking value and € 60,00 from € 500,00 booking value per cancellation.
Cancellation by the Damüls Ski School
If
the weather conditions do not guarantee the performance of the booked
service for safety reasons, Damüls Ski School has the option of
postponing or cancelling the booked service. In the event of
cancellation of the booked service, Damüls Ski School undertakes to
refund the fee paid for the booked service to the customer within 14
days of the date of cancellation.
Accident insurance
The
customer acknowledges that the practice of skiing is associated with
numerous risks and that there is a possibility that the customer may get
into difficulties in the mountains, particularly when travelling in
open terrain. The customer further acknowledges that the rescue of
persons in mountain distress, in particular by air and mountain rescue
services, can lead to high costs. The Customer is advised to take out
appropriate leisure insurance (in particular to cover rescue and air
rescue costs), especially as Damüls Ski School is not liable for such
rescue and air rescue costs, unless Damüls Ski School has caused these
rescue and/or air rescue costs through intentional or grossly negligent
behaviour on the part of Damüls Ski School, its legal representatives or
its vicarious agents.
Group size and lesson times
If a group course is reduced to 2 people, the lesson time will be shortened:
- 2 hours for two participants
- 1 hour for one participant
Lessons can be continued in the afternoon for an additional charge!
Multiple instructor changes are possible due to the flexible organisation.
Lift prices are not included in the ski school tickets.
Vouchers
Vouchers
can be redeemed at the Damüls Ski School office. Pre-booking by e-mail,
telephone or in person is essential. If the value of a voucher exceeds
the value of the service used, the customer will be issued with a new
voucher for the difference. This voucher can be redeemed for the
remaining (residual) amount for a further use of services of the Damüls
Ski School. A cash redemption of the (remaining) value is excluded in
any case, i.e. also in the case of non-redemption. The original period
of validity of the voucher is not affected by the issue of a new voucher
for the difference, so that the original period of validity is not
extended.
Warranty
The Damüls Ski School
guarantees the customer that the booked service corresponds to the
contract, but without guaranteeing the customer any success.
Liability
Damüls
Ski School is not liable for damages - with the exception of personal
injury - unless the damages are due to intentional or grossly negligent
behaviour on the part of Damüls Ski School, its legal representatives or
its vicarious agents, and the behaviour causing the damage does not
relate to the liability obligations of Damüls Ski School arising from
the contract concluded. This exclusion of liability does not apply to
completely unforeseeable or atypical damage that the customer could not
have expected.
In particular, the Damüls Ski School assumes no
liability for damages that the customer inflicts on himself or other
persons during the execution of the agreed service or that are inflicted
on him by them.
The services provided by the Damüls Ski School
take place exclusively outdoors, on ski pistes or in open terrain under
sometimes difficult to very difficult conditions. Unfavourable weather
conditions such as rain, snow or fog can make conditions even more
difficult.
The customer must inform the Damüls Ski School
truthfully and comprehensively about his abilities and experience in
connection with snow sports. The Customer must also inform Damüls Ski
School comprehensively about his physical abilities, in particular his
state of health and any ailments.
The services provided by the
Damüls Ski School can place high demands on the equipment as well as on
the physical fitness and skiing technique of the customer at every skill
level. Every customer is therefore requested to participate in the
booked services only with properly maintained sports equipment and the
usual prescribed safety equipment and to realistically assess their own
ability.
The customer is advised that failure to wear a helmet in
the event of injury may constitute contributory negligence on the part
of the customer, which is why the customer is recommended to wear a
helmet and other safety equipment recommended for the service booked
(e.g. avalanche transceiver for off-piste skiing).
